1. Acceptance of Terms

By downloading, installing, or using the Remix Poet mobile application (“App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Evidence Publishing Inc. (“we,” “us,” or “our”), a corporation registered in Ontario, Canada.

2. Description of Service

Remix Poet is a creative tool that allows users to create “blackout poetry” by selecting words from source texts to form new poems. The App provides:

Core Features

Content Packs: Curated collections of source texts from various authors and genres
Creative Tools: Word selection, poem composition, and styling features
Theme System: Thematic word collections to enhance creative expression
Palette System: Curated color collections for sophisticated poem styling
Style Editor: Customization options for poem appearance and layout
Collection Management: Save, organize, and view your created poems
Achievement System: Track your progress and unlock achievements
Sharing Features: Export and share your poems with others
High-Resolution Export: Optional purchase to unlock professional-quality downloads for printing

Content Delivery

Some content (Packs, Themes, Palettes) is delivered via content delivery network (CDN)
Downloaded content is stored locally on your device for offline use
Internet connection required for browsing and downloading additional content

3. User Accounts and Data

No Account Required

Remix Poet does not require user registration or account creation. You can use the App immediately after installation.

Local Data Storage

All your poems, settings, and personal data are stored locally on your device
We do not collect, store, or have access to your personal information
Your creative work remains private unless you choose to share it

Data Security

Your poems and personal information are encrypted using industry-standard AES-256 encryption
Encryption keys are stored securely in your device’s iOS Keychain
We implement additional security measures as described in our Privacy Policy

iOS Backups

If your device is backed up to iCloud or iTunes, your encrypted app data may be included in the backup
Restoring from backup may restore your poems and settings
We have no access to or control over backup data
Backup behavior is controlled by iOS and Apple’s backup policies

4. Acceptable Use

Permitted Uses

You may use the App to:

Create original blackout poetry from provided source texts
Save and organize your creative work
Share your poems with others through the App’s sharing features
Use the App for personal, educational, or creative purposes
Purchase and use additional content (Packs, Themes, Palettes)
Purchase high-resolution exports of your poems for printing

Prohibited Uses

You agree NOT to use the App to:

Create content that is illegal, harmful, threatening, abusive, or defamatory
Infringe on the intellectual property rights of others
Attempt to reverse engineer, decompile, or modify the App
Use the App for commercial purposes without proper licensing
Share content that violates any applicable laws or regulations
Create content that promotes violence, discrimination, or hate speech
Circumvent or disable any security features or usage restrictions

5. Intellectual Property Rights

Your Creative Work

You retain full ownership of the poems you create using the App
You have the right to share, publish, or commercially use your poems as you see fit
We do not claim any ownership rights to your creative work
We make no representations about the originality, copyright status, or third-party rights in your work

Your Responsibility

You are solely responsible for:

Ensuring your poems do not infringe third-party rights
Obtaining necessary permissions for commercial use of your work
Complying with applicable copyright laws
Determining whether source texts are suitable for your intended commercial use
Conducting your own copyright due diligence

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of created poems, including claims of copyright infringement, defamation, or violation of third-party rights.

Limitations on Our Liability for Your Content

We do not review, approve, or endorse user-created content
We are not responsible for the copyright status of user creations
We do not warrant that source texts are suitable for commercial use
Users must conduct their own legal due diligence

App Content and Source Texts

The App’s source texts are provided for creative use within the App
Original works remain the property of their respective copyright holders
Public domain works are used in accordance with applicable laws
Licensed content is used with appropriate permissions and attributions

App Software and Design

The App software, design, and user interface are protected by copyright and other intellectual property laws
You may not copy, modify, distribute, or create derivative works of the App
All trademarks, logos, and brand elements remain our property

6. Privacy and Data Protection

Privacy-First Design

We do not collect personal data or track your activity
Your poems and settings stay on your device
No ad networks, third-party ads, or third-party analytics
The App keeps simple counts of actions on your device; they are never sent to us or anyone else
The Browse screen may show promotions for Remix Poet and other Evidence Publishing products

Third-Party Services

While we do not collect personal data, the following third-party services are required for App functionality:

Apple App Store & In-App Purchases:

Processes all purchase transactions
Stores purchase history on your Apple ID
May collect device identifiers and payment information

Restoration of non-consumable purchases requires Apple ID authentication
Consumable purchases (high-resolution exports) are not restored

RevenueCat (IAP Management):

Processes purchase verification and entitlement management
Collects: Purchase receipts, device identifiers, app user IDs
Syncs purchase status across devices for non-consumable purchases
Does NOT process payment information (handled by Apple)

Data Handling

Your poems and personal information are encrypted and stored locally
We do not have access to your data
You have complete control over your data and can delete it at any time

7. Age Restrictions and Children’s Privacy

Age Requirements

The App is suitable for users of all ages
Users under 13 should have parental supervision
We do not knowingly collect personal information from children

COPPA Compliance

We do not knowingly collect data from children under 13
Because all data is stored locally and we collect no personal information, the App is compliant with COPPA requirements

Parental Guidance

Parents and guardians are responsible for supervising their children’s use of the App
The App contains literary content that may require age-appropriate guidance
We recommend reviewing source texts before allowing children to use them
Parents can control in-app purchases through iOS Screen Time and App Store purchase restrictions

8. Disclaimers and Limitations

App Availability

The App is provided “as is” without warranties of any kind
We do not guarantee uninterrupted or error-free operation
The App may not be available in all regions or on all devices
Features and functionality may change with updates

Fitness for Purpose

No warranty that the App meets your specific requirements
No warranty regarding the creative quality of generated poems
No warranty regarding the commercial viability of created works
Users are responsible for determining suitability for their purposes

Content Disclaimer

Source texts are provided for creative use only
We do not endorse or take responsibility for the content of source texts
Users are responsible for their interpretation and use of source material
No warranty regarding historical accuracy or completeness of source texts
We make no representations about source text copyright status

High-Resolution Export Disclaimers

No warranty regarding exact resolution or quality of exports
Quality depends on device capabilities, iOS version, and content complexity
File size and format may vary based on technical limitations
Export process is provided “as-is” without guarantees
Generation may fail due to device memory, iOS limitations, or other technical factors
We are not responsible for print quality when using third-party printing services

Limitation of Liability

Maximum Liability:
To the maximum extent permitted by law:

Our total liability is limited to the amount you paid to us in the past 12 months
For users who have not made any purchases, liability is limited to CAD $50
We are not liable for any indirect, incidental, special, consequential, or punitive damages

Excluded Damages:
We are not responsible for:

Lost profits or business opportunities
Data loss (beyond reasonable backup and recovery efforts)
Damage to reputation
Loss of creative work
Costs of replacement goods or services
Any damages arising from third-party actions

Canadian Law Considerations:

Some consumer protections cannot be waived under Canadian law
Liability for gross negligence or willful misconduct cannot be limited
Death or personal injury liability cannot be limited (though not applicable to this App)

9. In-App Purchases

The App offers two types of in-app purchases with different terms and expectations:

A. Non-Consumable Purchases (Packs, Themes, Palettes)

What They Are:

Content Packs: Collections of source texts for creating poems
Themes: Thematic word collections that enhance creative expression
Palettes: Curated color collections for poem styling

Perpetual Access:

Once purchased, you have access “as long as technically feasible”
Purchases can be restored on multiple devices using your Apple ID
Downloaded content remains on your device even if removed from our store
Access subject to continued App availability and iOS compatibility

Content Modifications:

We reserve the right to modify, update, or replace content in purchased Packs, Themes, and Palettes
Changes may be made to improve quality, fix errors, ensure compatibility, or comply with legal requirements
Modified content will maintain substantially similar creative value and utility
Major changes will be communicated through app updates when feasible

Delivery:

Non-consumable purchases are delivered via CloudFront CDN
Downloaded content is stored locally on your device
Internet connection required for initial download
Re-download available at any time through the App

Discontinuation:

Individual content may be removed from our store with reasonable notice (typically 90 days)
Already-purchased and downloaded content remains accessible on your device
CDN delivery may be discontinued with reasonable notice
We are not obligated to provide refunds for discontinued content that was previously delivered

B. Consumable Purchases (High-Resolution Exports)

What They Are:

Single-use unlock that allows you to download high-resolution PNG files of a specific poem
Perfect for printing at home, professional printing services, or printing on custom items

Single-Use Transaction:

This is a consumable purchase tied to a specific poem
Each purchase unlocks ONE poem for high-resolution download
Cannot be restored if the poem is deleted or the app is reinstalled
If you delete the poem and recreate it, you will need to purchase again
No restoration across devices

Technical Specifications:

Format: 2700 × 4050 pixel transparent PNG files
Print Size: Suitable for prints up to 9×13.5 inches
Versions Included: Up to four versions, depending on your poem’s styling:
- Color version
- Color inverted version (when your poem uses a colored style element with white text container backgrounds)
- Black version: Black text on transparent background
- Black inverted version: White text on black background
Generation: Instant (typically within seconds)
Transparency: PNG format with transparency for versatile printing on various items

Delivery:

Files are delivered via iOS Share Sheet
You choose the destination: Photos, Files, AirDrop, Mail, Print, etc.
We do not store copies of your exported images
Files are saved to your chosen destination, not to our servers
You can download multiple times after purchase (as long as the poem remains in your collection)

No Scene or Frame:

High-resolution downloads do not include background mockups or frames
This makes them ideal for printing on hoodies, mugs, phone cases, etc.
You receive only the poem text and blackout pattern with transparency

Best Efforts Delivery:

High-resolution images are generated using best efforts
Actual resolution and quality may vary based on:
- Device capabilities (memory, processing power)
- iOS version and system limitations
- Content complexity (number of words, styling choices)
- System resources available at time of generation

Technical Limitations:

Maximum resolution, file size, and export capabilities are subject to iOS limitations and device capabilities
Generation may fail on older devices with limited memory
Complex poems with many styling elements may take longer to process
Very large files may not be shareable via certain methods (e.g., email)

No Storage or Re-Delivery:

Exported images are delivered directly to your chosen destination
We do not store copies on our servers
If you lose the files, you can re-download them as long as:
- The poem remains in your collection
- You have not deleted the App
- You have not deleted the poem
If the poem is deleted, you will need to purchase again if you recreate it

Refund Policy:

Generally not refundable after successful generation and delivery
If generation fails due to a technical error, contact Apple Support
Technical issues should be reported to us before requesting a refund
We cannot re-deliver consumable purchases that have been refunded by Apple

10. Refunds and Purchase Disputes

Refund Policy

All Purchases Processed by Apple:

All in-app purchases are processed through the Apple App Store
We do not control or process refunds directly
Refund requests must be submitted through Apple
Apple’s refund policies apply to all purchases
Request refunds at: https://support.apple.com/billing

Non-Consumable Purchases (Packs, Themes, Palettes):

May be eligible for refund per Apple’s policies
Typically no refunds after content has been downloaded and used
We cannot restore content if it has been refunded by Apple
Refunded purchases will be revoked from your account

Consumable Purchases (High-Resolution Exports):

Generally not refundable after successful generation and delivery
If generation fails due to technical error, contact Apple Support
Technical issues should be reported to us first at info@evidence.pub
We will attempt to resolve technical issues within a reasonable timeframe
We cannot re-deliver consumable purchases that have been refunded by Apple

Dispute Resolution

Technical Issues:

Report technical problems to us first: info@evidence.pub
Provide details: device model, iOS version, description of issue
We will attempt to resolve within a reasonable timeframe (typically 3-5 business days)
If unresolved, you may request a refund through Apple

Purchase Problems:

If you believe you were charged incorrectly, contact Apple Support
For questions about purchase history, check your Apple ID purchase history
For entitlement issues (purchases not appearing), contact us at info@evidence.pub

Apple Processes All Refunds:

We cannot issue refunds directly
All refund decisions are made by Apple
Apple’s terms of service govern the refund process

11. Service Discontinuation and Updates

Right to Modify Service

Service Changes:

We may update, modify, or discontinue the App at any time
In-app purchase offerings may be modified or discontinued with notice
Features may be added, changed, or removed in updates
We will provide reasonable notice for major changes (typically 90 days for content removal)

No Guarantee of Continued Service:

We are not obligated to maintain the App indefinitely
Service may be discontinued for business, technical, or legal reasons
Updates and new features are provided at our discretion

Content Discontinuation

Individual Content Removal:

Individual Packs, Themes, or Palettes may be removed from our store
We will provide reasonable notice (typically 90 days) before removal
Already-purchased content remains accessible on your device
Downloaded content remains usable after removal from store
CDN delivery may be discontinued with reasonable notice

Effect on Already-Purchased Content:

Content you have already downloaded remains on your device
Local access to downloaded content is not affected by store removal
Re-download may not be available after CDN discontinuation
No refunds provided for discontinued content that was previously delivered

App Discontinuation

If We Discontinue the App:

We will provide reasonable notice (typically 90 days) before discontinuation
Already-created poems and purchased content remain on your device
Local functionality may continue to work for content already downloaded
CDN services for downloading additional content may cease
No refunds for discontinued service (content remains on your device)
We recommend backing up your poems before app discontinuation

Your Data After Discontinuation:

Your locally stored poems remain on your device
You can export poems before discontinuation
We cannot provide support after discontinuation
Data cannot be migrated to other services

iOS Compatibility

Updates and Compatibility:

We are not obligated to maintain compatibility with all iOS versions
Older iOS versions may not receive updates
New iOS versions may require app updates at our discretion
Some features may require minimum iOS versions
The App may cease to function on very old iOS versions

Your Responsibilities:

Keep your iOS updated for best performance
Some features may not work on older devices
We recommend backing up your poems regularly

12. Legal and Jurisdiction

Governing Law

Ontario, Canada:

These Terms are governed by the laws of the Province of Ontario, Canada
Federal laws of Canada apply where applicable
Conflict of law principles are excluded
Disputes are subject to the exclusive jurisdiction of courts in Ottawa, Ontario

Consumer Protection:

Ontario consumer protection laws apply to Ontario residents
Federal privacy legislation (PIPEDA) may apply
You may have additional rights that cannot be waived by these Terms

Quebec Users:

Quebec residents may have additional rights under Quebec law
Some provisions may be governed by Quebec’s Consumer Protection Act
French language rights apply as required by Quebec law

Apple’s Terms

Licensed Application End User License Agreement:

Apple’s Licensed Application End User License Agreement (LAEULA) applies
Some provisions may be governed by California law (Apple’s terms)
App Store terms are governed by Apple’s agreements
Conflicts resolved per Apple App Store guidelines

International Users

Availability:

The App may not be available in all countries
Content availability may vary by region
Export control laws may apply to some content
Users outside Canada are still subject to Ontario law

Language:

These Terms are provided in English
English version controls in case of translation disputes
French translation available for Quebec residents upon request

13. Severability and Entire Agreement

Severability

Invalid Provisions:

If any provision of these Terms is found to be invalid, illegal, or unenforceable:
- The remaining provisions continue in full force and effect
- The invalid provision will be modified to the minimum extent necessary to make it valid
- The invalidity of one provision does not affect the validity of other provisions

Savings Clause:

If a limitation on liability is found unenforceable, it will be limited to the maximum extent permitted by law
If a waiver is found unenforceable, you retain those rights
The rest of these Terms remain binding

Entire Agreement

Complete Understanding:

These Terms constitute the entire agreement between you and Evidence Publishing Inc.
These Terms supersede all prior agreements, understandings, or representations
No oral modifications are permitted
Changes must be made in writing and accepted by both parties

No Reliance:

You are not relying on any statements not contained in these Terms
Any prior representations or discussions are superseded by these Terms
If you have questions, contact us before using the App

Amendments

How We Update These Terms:

We may update these Terms from time to time
Updates will be reflected in the “Last Updated” date
Significant changes will be announced in the App
Continued use after changes constitutes acceptance
You can review the current Terms at any time in the App or on our website

Your Options:

If you disagree with updated Terms, discontinue use of the App
Continued use means you accept the updated Terms
Download and save your poems before discontinuing use

14. Changes to These Terms

Updates and Modifications

Right to Modify:

We reserve the right to update or modify these Terms at any time
Changes effective immediately upon posting (or as specified in notice)
Material changes will be communicated through:
- In-app notification
- Update to “Last Updated” date at top of Terms
- Notice on our website

Your Acceptance:

Continued use of the App after changes constitutes acceptance
If you do not agree to modified Terms, you must stop using the App
We recommend reviewing Terms periodically

Notification Methods:

Significant changes: In-app alert or notification
Minor changes: Updated “Last Updated” date
Major policy changes: Email notice (if email provided for support)

15. Future Services Disclosure

Analytics and Crash Reporting

Current Status:
We do not use third-party analytics, crash reporting, or usage tracking services. The App keeps simple counts of actions (for example, how often a screen is opened) on your device. These counts are never sent to us or anyone else, and Reset Data deletes them.

If We Implement These Services in the Future:

We will update these Terms and our Privacy Policy
We will notify you through an app update notice
You will have the opportunity to review the updated policies
Continued use after notice constitutes acceptance
You will maintain the right to stop using the App if you disagree

Possible Future Services:

Crash reporting to improve app stability
Anonymous usage analytics to improve features
Performance monitoring to optimize app speed
No personally identifiable information will be collected without notice
